Jim Ruttler is a downtown Seattle, Washington based attorney licensed to practice both patent and trademark law before the United States Patent and Trademark Office. He graduated from Ramstein H.S. in Germany and attended the University of Washington where he earned a degree in neurobiology. After working in the field of healthcare software, Jim returned to graduate school and earned law and MBA degrees from Seattle University with honors. He and his wife and their young son live on Bainbridge Island, Washington.

Sugarcraft v. Cake Central (Case No. 92048419)
Sugarcraft sued my client Cake Central for alleged trademark infringement in Ohio. Taking the offensive, we filed a petition for cancellation with the U.S. Trademark Office seeking cancellation of Sugarcraft's trademark. Sugarcraft immediately dismissed their lawsuit with prejudice and without any damages being awarded.
Commonwealth v. SFBS (Case No. 92048086)
Commonwealth filed a petition to cancel my client's SFBS registered trademark with the U.S. Trademark Office. We answered their complaint, conducted written discovery, and took the offensive by filing a motion for summary judgment seeking to dismiss the complaint on the grounds of geographic deceptiveness, abandonment, and laches. The motion is awaiting review by the Board.
ACE v. ACE Wellness (Case No. 91181226)
American Council on Exercise filed an opposition against my client's trademark applicationn with the U.S. Trademark Office. We answered their opposition, conducted written discovery, and took the offensive by filing a motion for summary judgment seeking dismissal of the opposition on the grounds of no likelihood of consumer confusion. The motion is awaiting review by the Board.
Woodtone Industries USA v. Niedermeyer-Martin Company (Case No. 92049433)
Niedermeyer-Martin owned a trademark registration for a trademark that has been abandoned through non-use. We petitioned to cancel the trademark registration and moved for a default judgment after Niedermeyer-Martin failed to timely answer the Petition.
